  • Successfully litigated that University faculty are managerial employees exempt from forming a union under the National Labor Relations Act.
  • Successfully decertified a labor union through an election proceeding and defending the subsequent unfair labor practice charges filed by the union.
  • Successfully defended an institution of higher education from claims that it violated the Title IX rights of a student.
  • Successfully brought an injunction to stop a railroad company from placing railroad cars on a pedestrian crossing that provided access between a company’s manufacturing building and warehouse building.
  • Litigated the right of a bank to take possession of property the Bank had foreclosed upon but prior to the foreclosure had been sold at an upset tax sale when the upset tax sale purchaser took the property subject to the bank’s mortgage.
  • Successfully brought an injunction action to stop the use of a property as a motocross racetrack when the property had been rightfully foreclosed upon and the ownership transferred to the Bank.
  • On behalf of a medical servicer for the federal bureau of prisons we were successful in having a Motion to Dismiss being granted and the Complaint dismissed on the basis that all claims asserted by the inmate were frivolous and a claim could not be asserted against the medical servicer.
  • Was granted summary judgment by the United States District Court for the Middle District of Pennsylvania upholding the validity of a lease entered into prior to natural gas being located in the region. The litigation proceeded to the 3rd Circuit Court of Appeals, which upheld the decision of the lower court.
  • Successfully won the dismissal of a case prior to trial based upon the Plaintiff’s failure to provide discovery responses. The dismissal was granted as a sanction for violations of the Court’s discovery orders which was upheld by the 3rd Circuit Court of Appeals as just and proper.
